User Service Agreement

1. Parties

This Service Agreement ("Agreement") is made between Hostagen Web Hosting Services, headquartered at Serdar Mah. Küba Sok. No:8 Başiskele, Kocaeli ("Company"), and the customer receiving the services ("Customer") under the terms set forth below.

2. Subject

This Agreement regulates the rights and obligations of the parties regarding the web hosting, domain registration, server rental, and other internet services provided by the Company to the Customer.

3. Description and Scope of Services

The Company shall provide the Customer with the following services:

• Web hosting services,
• Domain registration and management,
• Server rental and hosting services,
• Technical support services,
• Email services and other supplementary services.

4. Rights and Obligations of the Parties

4.1. Obligations of the Company

• Ensure uninterrupted and secure delivery of the services,
• Keep customer information confidential and not share it with third parties,
• Intervene in technical issues and provide solutions.

4.2. Obligations of the Customer

• Use the services within legal boundaries,
• Pay the service fees on time,
• Not misuse the services or cause harm to third parties.

5. Pricing and Payment Terms

• The Customer agrees to pay the fees determined by the Company for the purchased services.
• Payments can be made via bank transfer, credit card, or other payment methods provided by the Company.
• In case of late payments, the service may be suspended.

6. Duration and Termination of the Service

• The Agreement becomes effective as of the purchase date of the service and remains valid for the duration of the service.
• Either party may terminate the agreement by providing written notice.
• No refund shall be issued for termination initiated by the Customer.

7. Confidentiality and Data Security

• Customer data will be kept confidential and shall not be shared with third parties unless required by law.
• The Company is obliged to take necessary precautions to ensure the security of customer data.

8. Force Majeure

• The Company shall not be held liable for service interruptions caused by force majeure events such as natural disasters, war, terrorist attacks, or government interventions.

9. Dispute Resolution

• Disputes arising from this Agreement shall be subject to the jurisdiction of the Courts and Enforcement Offices of Kocaeli, and Turkish Law shall apply.

10. Enforcement

• By purchasing services from the Company, the Customer declares and undertakes that they accept the terms of this Agreement.
• This Agreement shall enter into force as of the date the Customer purchases the service.

Personal Data and General Privacy Agreement

1. General Provisions

This agreement sets forth the principles regarding the protection of personal data and privacy within the scope of the services provided by Hostagen Web Hosting Services ("Company").

2. Collection and Use of Personal Data

• The Company shall process personal data provided by the Customer such as name, surname, address, phone number, and email address for the purpose of providing and improving its services.

• The collected data may be shared with relevant public authorities when required by legal obligations.

• The Customer gives explicit consent for the processing of their personal data.

3. Protection of Personal Data

• The Company shall take technical and administrative measures to ensure the security of personal data.

• Necessary precautions will be taken to prevent unauthorized access, data loss, or misuse.

4. Retention Period of Personal Data

• The Company shall retain personal data only for the period specified in the relevant legislation.

• Once the legal period expires, the data will be securely deleted or anonymized.

5. Rights of Data Subjects

The Customer has the following rights regarding their personal data:

• To inquire whether their personal data has been processed,

• To request information about the processed data,

• To request correction of incomplete or inaccurate data,

• To request deletion or destruction of their data,

• To inquire whether the data has been shared with third parties.

6. Use of Cookies

• The Company may use cookies to improve service quality.

• Users can disable cookies through their browser settings.

7. Entry into Force

• By using the Company's services, the Customer is deemed to have accepted the terms of this agreement.

• This agreement enters into force on the date the service is purchased.
